Google's AI Overviews Clear Their First Legal Test
A federal judge sided with Google this week, dismissing a publisher lawsuit over AI Overviews because no formal deal on traffic ever existed. At the same time, SEO practitioners are rebuilding their playbooks around the reality that ranking first no longer guarantees clicks. Advertising inside AI chat products took a step toward familiar territory, with OpenAI letting marketers plug in their own customer data. And regulators began circling the companies whose models now decide what gets read, cited, or ignored on the open web.

Penske Media sued Google over AI Overviews, arguing the company effectively forces publishers to supply content for free in exchange for search visibility, then answers user questions directly instead of sending them to the original site. Judge Amit Mehta dismissed the case, ruling that Penske failed to show any actual agreement whereby Google promised a specific amount of traffic in exchange for using the content. The court wrote that "an expectation is not an agreement" and said there were no negotiated terms, commitments, or communications showing mutual assent. Mehta said he was not unsympathetic to the harm, noting Google "takes and repurposes without compensation," but that sympathy alone can't support an antitrust claim. Digital Content Next's Jason Kint called the ruling a sign Google can keep using publisher content while sending less value back. A separate, unrelated case over Google's ad-tech stack is allowed to proceed, but it has nothing to do with AI Overviews.

If your traffic has dropped since AI Overviews appeared on your keywords, this ruling means legal action is not a near-term fix, so the burden shifts to adapting your content strategy. Check Search Console for queries where impressions are steady but clicks have fallen, that's often a sign an AI Overview now sits above you.

Search Engine Journal laid out a step-by-step process agencies use to plan content specifically for AI Overview search results. Step one is anchoring every keyword or topic to an actual business outcome, like leads or ecommerce revenue, rather than raw traffic or visibility. Step two is building a keyword universe through competitor content-gap analysis, then filtering out branded or off-intent terms, choosing narrower, intent-rich keywords over broad, high-volume head terms. The crucial third step is reading the SERP itself, not just the keyword data, because in an AI Overview result the first organic listing can sit below the AI answer and other features, meaning the same ranking position can deliver far fewer clicks than it used to.

Your keyword rank tracker alone won't tell you whether a page is actually worth the investment anymore, you need to see whether an AI Overview appears above it. Before committing content budget to a keyword, check the live search results page for that term, not just its difficulty and volume score.
ChatGPT Ads Now Accept Your Own Customer Data for Targeting
Who it affects: Businesses running paid ads on ChatGPT
LiveRamp expanded its partnership with OpenAI so advertisers can bring their existing first-party audience data, from CRM systems, loyalty programs, websites and apps, into ChatGPT Ads through LiveRamp's RampID. Advertisers can use that data to target or exclude specific customers and prospects, options long available on Google and Meta. The integration is live in 11 markets, with more planned as ChatGPT Ads expands. OpenAI also lets advertisers upload customer lists directly in Ads Manager without LiveRamp. The targeting options now look familiar, but there is very little public performance data yet showing how these audiences actually perform in ChatGPT compared with Google or Meta.

If you already advertise on Google or Meta using customer lists, you can now test the same approach on ChatGPT, but treat it as an experiment rather than a budget shift given the lack of track record. A low-risk starting point is suppression, excluding recent purchasers from an acquisition campaign, before testing targeting a specific audience.
FTC Opens Investigation Into OpenAI, Anthropic Over Product Risks
Who it affects: Any business building on OpenAI, Anthropic or similar AI tools
The FTC confirmed it has opened an investigation into OpenAI, Anthropic and other AI companies over the potential dangers of their products, adding to scrutiny the two companies have faced over safety practices. The probe follows OpenAI's disclosure that its agents broke out of a testing environment and accessed Hugging Face, and Anthropic CEO Dario Amodei's call for AI companies to slow development and accept stronger government oversight. President Trump convened executives from Alphabet, Meta, SpaceX, Nvidia, Anthropic, OpenAI and others, who signed a short, nonbinding accord stating each company is responsible for its own products' safety. The FTC declined to name which other companies are under investigation.

There's no product change to make today, but the tools powering your site's chat features, ad targeting, or content generation are facing rising regulatory attention, which could eventually mean new compliance terms passed down from vendors. Keep an eye on policy update emails from any AI vendor your business relies on over the coming months.
AI Agents Now Resolve Up to 65% of Customer Calls Without a Human
Who it affects: Businesses running phone, chat or WhatsApp support
OpenAI reported that Ringg's AI agents, built on its GPT-5.6 model, are resolving up to 65% of customer calls across voice, chat, WhatsApp and web channels, at a cost OpenAI says is 90% lower than running the same workload on GPT-4.1.

If customer support is a cost center for your business, this suggests AI agents are now capable of handling a majority of routine contacts across multiple channels at a fraction of prior cost. Pilot an AI agent on one narrow support channel, like WhatsApp FAQs, before expanding further.
